Liability Waiver & Assumption of Risk

This waiver must be acknowledged before participating in any adventure activity with BlackBeards Tours & Travel.

⚠️ IMPORTANT: Please read this document carefully. By participating in any activity organized by BlackBeards Tours & Travel, you agree to these terms. A physical or digital signature will be required before participation in any adventure activity.

1. Acknowledgment of Risk

I, the undersigned participant, acknowledge and understand that the activities offered by BlackBeards Tours & Travel — including but not limited to scuba diving, paragliding, skydiving, canyoning, river tubing, hiking, and boat excursions — involve inherent risks of serious injury or death. These risks include, but are not limited to: drowning, falls, equipment failure, extreme weather, natural hazards, physical exhaustion, and wildlife encounters.

2. Voluntary Participation

I voluntarily choose to participate in the selected activity with full knowledge of the risks involved. I confirm that I am physically capable of participating and have not been advised by a physician against such activities.

3. Release of Liability

In consideration of being permitted to participate, I hereby release, waive, discharge, and covenant not to sue BlackBeards Tours & Travel, its owners, employees, guides, contractors, partner operators, and agents from any and all liability, claims, demands, actions, or causes of action arising from my participation in any activity, including claims arising from the negligence of the released parties, to the fullest extent permitted by Dominican Republic law.

4. Indemnification

I agree to indemnify and hold harmless BlackBeards Tours & Travel from any claim made by or on my behalf (including by my heirs or legal representatives) arising out of my participation in any activity.

5. Medical Authorization

I authorize BlackBeards Tours & Travel and its guides to obtain emergency medical treatment on my behalf if I am incapacitated. I acknowledge that I am responsible for all costs associated with any such emergency treatment.

6. Emergency Contact

I agree to provide an emergency contact name and phone number prior to participation in any activity. I authorize BlackBeards to contact this person in case of emergency.

7. Photographic Release

I grant BlackBeards Tours & Travel permission to use photographs or video taken of me during activities for promotional and marketing purposes, unless I notify them in writing prior to the activity that I do not consent to this use.

8. Governing Law

This waiver shall be governed by the laws of the Dominican Republic and any disputes shall be resolved in the courts of Santiago de los Caballeros, Dominican Republic.

9. Severability

If any portion of this waiver is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
